Terms of Use for EurekaVoice

1. Introduction

Welcome to EurekaVoice (“App,” “we,” “us,” or “our”). These Terms of Use (“Terms”) govern your access to and use of the EurekaVoice mobile application and related services. By downloading, installing, or using EurekaVoice, you agree to be bound by these Terms.

If you do not agree to these Terms, do not use this App.

2. Subscription Terms

2.1 Subscription Plans

EurekaVoice offers the following auto-renewable subscription options:

  • Monthly Subscription: $6.99 USD per month (or equivalent in your local currency)
  • Yearly Subscription: $59.99 USD per year (or equivalent in your local currency)

Prices are subject to change with 30 days’ notice.

2.2 What’s Included

Your subscription grants access to:

  • Unlimited voice recording and transcription
  • Multi-language transcription support
  • Advanced search functionality
  • Content export in multiple formats
  • Cloud synchronization across devices
  • Priority customer support

2.3 Free Trial

Some subscription plans may include a free trial period (e.g., 7 days for the yearly subscription). If you start a free trial, your subscription will automatically renew at the regular subscription price unless you cancel before the trial period ends.

3. Auto-Renewal

3.1 Automatic Renewal

Your subscription will automatically renew at the end of each billing period (monthly or yearly) unless you disable auto-renewal in your Apple Account settings. You will be charged the current subscription rate at renewal unless the price changes.

3.2 Billing

Charges will be made to your Apple Account at the end of each billing cycle. You can view your charges and manage your payment method through your Apple Account settings.

3.3 Managing Your Subscription

You can manage your subscription and turn off auto-renewal at any time:

On iPhone or iPad:

  1. Open the Settings app
  2. Tap your name at the top of the screen
  3. Tap Subscriptions
  4. Tap EurekaVoice
  5. Tap Cancel Subscription or manage renewal settings

On Mac:

  1. Open System Settings (or System Preferences)
  2. Go to [Your Name] → Subscriptions
  3. Find EurekaVoice
  4. Click Manage and select Cancel Subscription

If you cancel your subscription, you will lose access to premium features at the end of your current billing period. Your voice recordings and data will remain in your account for 90 days before deletion.

3.4 Notice of Cancellation

If you cancel during a free trial, your cancellation is effective immediately. If you cancel during a paid subscription period, your cancellation is effective at the end of the current billing cycle.

4. Refund Policy

4.1 Apple App Store Refunds

Refunds for subscriptions are issued by Apple according to their App Store Refund Policy.

You may request a refund directly from Apple within 14 days of purchase. For refund requests:

  1. Visit https://reportaproblem.apple.com
  2. Select the transaction
  3. Choose the reason and request a refund

4.2 Company Policy

We respect Apple’s refund policy completely. If you have any issues with your subscription, please contact our support team at [email protected], and we will work with Apple to resolve the matter.

5. User Obligations

5.1 Lawful Use Only

You agree to use EurekaVoice only for lawful purposes and in accordance with these Terms. You agree not to use the App:

  • To record conversations without consent (where required by law)
  • For any illegal or unauthorized purpose
  • To infringe on intellectual property rights of others
  • To harass, abuse, or harm others
  • To transmit spam, viruses, or malware
  • To circumvent security measures

You are solely responsible for ensuring that you have all necessary consents and comply with all applicable laws when recording conversations or voices. This includes:

  • Two-party consent states: Some jurisdictions require all parties to consent before recording
  • Privacy laws: GDPR, CCPA, and other privacy regulations may apply
  • Workplace policies: Ensure your employer permits recording

We are not liable for your violations of applicable recording consent laws.

6. Intellectual Property Rights

6.1 App Ownership

EurekaVoice and all its contents (including software, design, text, graphics) are owned by EurekaVoice or our licensors and protected by copyright, trademark, and other intellectual property laws.

6.2 Limited License

We grant you a limited, non-exclusive, non-transferable license to use the App for personal, non-commercial purposes. This license does not include:

  • Copying, modifying, or creating derivative works
  • Reverse engineering or decompiling
  • Distributing, selling, or renting the App
  • Using the App for commercial purposes

7. User Data and Privacy

7.1 Your Data Ownership

You retain full ownership of all voice recordings, transcriptions, and data you create in EurekaVoice.

7.2 Data Storage

  • Local Storage: Your voice recordings are stored locally on your device
  • iCloud Sync: If enabled, recordings are synchronized to your private iCloud account (end-to-end encrypted)
  • No Third-Party Sharing: We do not share your data with third parties

7.3 Data Deletion

You can delete your data at any time through the App. If you delete your iCloud backup, data will be permanently removed after 90 days.

8. Limitation of Liability

8.1 Disclaimer

THE APP IS PROVIDED “AS IS” WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. WE DISCLAIM ALL WARRANTIES, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

8.2 No Liability

IN NO EVENT SHALL EUREKAVOICE BE LIABLE FOR:

  • Loss of data or recordings
  • Interruption of service
  • Indirect, incidental, or consequential damages
  • Lost profits or business opportunities
  • Errors in transcription

This applies even if we have been advised of the possibility of such damages.

8.3 Service Availability

While we strive for 99.9% uptime, we do not guarantee continuous, uninterrupted access to the App or iCloud services. Access may be interrupted for maintenance, updates, or technical issues.

9. Modification of Terms

We reserve the right to modify these Terms at any time. Changes will be effective 30 days after posting the updated Terms in the App or on our website.

Your continued use of EurekaVoice following the posting of revised Terms means that you accept and agree to the changes.

10. Termination

10.1 Termination by You

You may terminate your use of EurekaVoice at any time by:

  1. Deleting the App from your device
  2. Canceling your subscription (as described in Section 3.3)

10.2 Termination by Us

We may suspend or terminate your access if you:

  • Violate these Terms
  • Engage in illegal activity
  • Breach our usage policies

11. Dispute Resolution

11.1 Informal Resolution

11.2 Governing Law

These Terms are governed by the laws of the United States, without regard to conflicts of law principles.

11.3 Arbitration

Any disputes shall be resolved through binding arbitration rather than court proceedings, except for injunctive relief to protect intellectual property rights.
